Oaktree Privacy Policy

  1. Definitions
  2. The Oaktree Foundation (the Oaktree) is committed to respecting the privacy of personal information collected by it, and is committed to complying with any applicable privacy legislation.

    “Personal information” means information which identifies a person as an individual or from which a person’s identity can be reasonably ascertained. A person’s name, address and credit card details are examples of personal information.

    "Health information” is a type of personal information that relates to a person’s health.

    “Oaktree”, unless otherwise indicated, refers to The Oak Tree Foundation Inc., Australia. 

  3. Jurisdiction
  4. The Oaktree's privacy obligations are regulated by the laws of the Commonwealth of Australia. Any disputes arising regarding the way in which Oaktree has handled personal information held by it will be resolved under the laws of the Commonwealth of Australia, and, where necessary, by the Courts of Australia. Oaktree Australia disclaims all liability to comply with privacy obligations imposed by the laws of any other jurisdiction. Overseas branches of The Oaktree Foundation will comply with any additional privacy obligations imposed under local laws.  

  5. Collection of Personal Information
  6. The Oaktree only collects personal information that is necessary for the Oaktree’s functions and activities. There are many circumstances in which the Oaktree may collect personal information, for example, the Oaktree may collect the contact details of a member of the public in order for the Oaktree to resolve any queries, or in relation to employment and volunteer recruitment.

    Generally, the Oaktree will try to collect personal information directly from the individual, however there are certain situations in which personal information about an individual may be collected from someone else. In either case, the Oaktree will take reasonable steps to ensure that that individual is aware of the purposes for which the information is collected.

    In certain circumstances the Oaktree may collect sensitive information such as health information. This information will only be collected with the consent of the individual or otherwise in accordance with the law.  

  7. Use and Disclosure of Personal Information
  8. The Oaktree will generally use and disclose personal information for purposes related to the main purpose for which the information was collected, or where the individual has consented to the use or disclosure.

    In addition, the Oaktree may disclose personal information to third party service providers who assist the Oaktree in providing its services. These may include companies which assist with data processing and analysis, research, mail services or maintenance. Personal information will only be disclosed to those third party service providers on a confidential basis so that the service provider can effectively provide those services.

    The Oaktree may otherwise use or disclose personal information where required or authorised by law, which may include emergency situations and assisting law enforcement agencies.  

  9. Access to database/mailing list
  10. The Oaktree will not allow access to the Oaktree’s database or mailing lists to any other organisation or individual.

    However, if the material another organisation or individual wishes to circulate through the Oaktree database is sympathetic with the Oaktree’s core values and is within the use anticipated by those on the mailing list, the Oaktree will take responsibility for the circulation and will ask that the organisation/individual to provide the Oaktree with a letter explaining their request.  

  11. Accessing and Updating Your Personal Information
  12. The Oaktree takes reasonable steps to make sure that the personal information collected, used and disclosed is accurate, complete and up-to-date.

    Individuals who need to access or correct any personal information held by the Oaktree about them are asked to send a request to info(at)theoaktree.org

    As much detail as possible should be provided by the individual about the particular information sought, in order to enable the Oaktree to retrieve it. An access fee may be charged to cover the costs of providing that information.

    In certain circumstances, the Oaktree may not be required by law to provide the individual with access to, or to correct, personal information. If this is the case, reasons will be given for that decision.  

  13. Security of Peronal Information
  14. The Oaktree takes reasonable steps to protect all of the personal information it holds from misuse and loss and from unauthorised access, modification or disclosure. This protection applies in relation to information stored in both electronic and hard copy form.  

  15. Feedback
  16. Any questions or feedback about privacy should be directed to privacy(at)theoaktree.org. Any complaints about the way in which the Oaktree has handled personal information held by it, will be handled by the Administration Team Leader in conjunction with the COO if necessary.
